OTTAWA - On Monday morning at 9 a.m. Judge Randall Basinger made his decision regarding the request for preliminary injunction. Basinger denied the Rd. 5 resident's request for preliminary injunction.

According to Ohio Revised Code 2727.02 an injunction is a legal action which seeks to restrain an act and is essentially a preventive remedy designed to guard against future injury rather than to afford redress for wrongs already suffered.

The residents who live along Road 5 went to court on Oct. 22 and Oct. 23 to try and get a preliminary injunction approved by the the court.

This injunction was to prevent the Putnam County Commissioners from violating the Open Meetings Act, continuing activities related to widening of County Road 5 and proposing resolutions regarding the appropriations of properties included in the Resolution dated April 5, 2012.

The preliminary injunction request was denied by Basinger.
